TenancyAgreement租约AnAgreementmadethedayof,betweentheLandlordandtheTenantasmoreparticularlydescribedinScheduleI.此合约由业主及租客(双方资料详列于附表一)于年月日订立:TheLandlordshallletandtheTenantshalltakethePremisesfortheTermandattheRentasmoreparticularlydescribedinScheduleIandbothpartiesagreetoobserveandperformthetermsandconditionsasfollow:业主及租客双方以详列于附表一的租期及租金分别租出及租入详列于附表一的物业,并同意遵守及履行下列条款:1.TheTenantshallpaytotheLandlordtheRentinadvanceonthefirstdayofeachandeverycalendarmonthduringtheTerm.IftheTenantshallfailtopaytheRentwithin7daysfromtheduedate,theLandlordshallhavetherighttoinstituteappropriateactiontorecovertheRentandallcosts,expensesandotheroutgoingssoincurredbytheLandlordinrelationtosuchactionshallbeadebtowedbytheTenanttotheLandlordandshallberecoverableinfullbytheLandlord.租客须在租期内每个月份第一天上期缴付指定的租金予业主。
倘租客于应缴租金之日的七天内仍未清付该租金,则业主有权采取适当行动追讨租客所欠的租金,而由此而引起的一切费用及开支将构成租客所欠业主的债项,业主将有权向租客一并追讨所欠款项全数。
2.TheTenantshallnotmakeanyalterationand/oradditionstothePremiseswithoutpriorwrittenconsentoftheLandlord.租客在没有业主书面同意前,不得对该物业作任何改动及/或加建。
3.TheTenantshallnotassign,transfer,subletorpartwiththepossessionofthePremisesoranypartthereoftoanyotherperson.ThistenancyshallbepersonaltotheTenantnamedtherein.租客不得转让、转租或分租该物业或其他任何部份或将该物业或其他任何部份的占用权让予任何其他人等。
此租约权益为租客个人拥有。
4.TheTenantshallcomplywithallordinances,regulationsandrulesofHongKongandshallobserveandperformthecovenants,termsandconditionsoftheDeedofMutualCovenantandSub-DeedofMutualCovenant(ifany)relatingtothePremises.TheTenantshallnotcontraveneanynegativeorrestrictivecovenantscontainedintheGovernmentLease(s)underwhichthePremisesareheldfromtheGovernment.租客须遵守香港一干法律条例和规则及该物业所属的大厦有关的公契内的条款。
租客亦不可违反属该物业地段内的官批地契上的任何制约性条款。
6.TheTenantshallduringtheTermkeeptheinteriorofthePremisesingoodandtenantablerepairandcondition(fairwearandtearanddamagecausedbyinherentdefectsexcepted)andshalldeliverupvacantpossessionofthePremisesinthesamerepairandconditionontheexpirationorsoonerdeterminationofthisAgreement.租客须在租约期内保持物业内部的维修状态良好(自然损耗及因固有的缺陷所产生的损坏除外)并须于租约期满或终止时将物业在同样维修状态下交吉回业主。
若租客在租期内并无干犯此合约内任何条款,则业主须于收回交吉的物业或一切租客欠款后(以较迟者作准)三十天内无息退还该保证金予租客。
但若租客拖欠根据此合约需要支付的租金及/或其他款项超过七天(无论有否以法律行动追讨)或若租客违反此合约内任何条款,业主可合法收回该物业而此租约将立被终止;业主可从保证金内扣除因租客违约而令业主所受的损失,而此项权利将不会影响业主因租客违约而可采取的其他合法行动的权利。
8.ProvidedtheTenantshallhavepaidtheRentandotheroutgoingsonthedaysandinthemannerhereinprovidedandobservedandperformthetermsandconditionshereincontainedandontheTenant’sparttobeobservedandperformed,theTenantshallpeacefullyholdandenjoythePremisesduringtheTermwithoutanyinterruptionbytheLandlord.若租客按时清缴租金和杂费及没有干犯此合约内任何条款,则业主不得在租约期内干扰租客享用该物业。
9.TheLandlordshallkeepandmaintainthestructuralpartsofthePremisesincludingthemaindrains,pipesandcablesinproperstateofrepairprovidedthattheLandlord’sliabilityshallnotbeincurredunlessanduntilwrittennoticeofanydefectorwantofrepairhasbeengivenbytheTenanttotheLandlordandtheLandlordshallhavefailedtotakereasonablestepstorepairandremedythesameafterthelapseofareasonabletimefromthedateofserviceofsuchnotice.业主须保养及适当维修物业内各主要结构部份(包括主要的排污渠、喉管和电线)。
唯业主须在收到租客的书面要求后才会有责任在合理时限内将有关损坏维修妥当。
10.TheLandlordshallpaythePropertyTaxpayableinrespectofthePremises.业主负责缴付有关该物业的物业税。
11.TheStampDutypayableonthisAgreementinduplicateshallbebornebytheLandlordandtheTenantinequalshares.业主及租客各负责属此合约一式两份的印花税一半费用。
12.TheLandlordandtheTenantagreetobeboundbytheadditionaltermsandconditionsinScheduleII(ifany).业主及租客双方同意遵守附表二的附加条件(如有的话)。
13.IfthereisanyconflictbetweentheEnglishversionandtheChineseversioninthisAgreement,theEnglishversionshallprevail.此合约内的英文本与中文本存有差异时,将以英文本为准。
